Regarding the 99% rule.  Students with special needs are included in the 
accountability systems now in place under NCLB.  However, you may notice 
that there are State Developed Alternative Assessments (SDAA) for some of 
these students.  Participating in these assessments should be noted in the 
child's Individual Education Plan.

Very few educators are for this assessment crazed era, but many special 
educators believe that if all students are included in the evaluation than 
students who qualify for Special Education services should not be left out 
(although the assessment will clearly be different as does their 
instruction).  Adequate yearly progress, if a goal for some, should be a 
goal for all.
