See below. Texas is scheduled to execute Heliberto Chi on Wednesday,
October 3, 2007.
Please join us tomorrow for a vigil to protest this execution. We will meet
at the corner of Walton and Texas Ave from 5:30 to 6 pm. If you have a lawn
sign, please post it all day Wednesday.
There is some discussion that Heliberto will receive a stay of execution
since the Supreme Court is hearing two Kentucky cases concerning the issue
that the lethal injection protocol is cruel and inhumane. However, at this
time there is no indication that a stay will be granted. If you are
planning to attend the vigil, check the TCADP website or Rick Halperin's
website ( http://people.smu.edu/rhalperi/pending.html) in the afternoon for
an update. We will send out an email if we learn there is a stay of
execution.

On October 3, 2007 , Texas is set to execute Heliberto Chi for the March 24
2001 murder of Armand Paliotta.
The state of Texas should not execute Chi for his role in this crime.
Executing Chi would violate the right to life as declared in the Universal
Declaration of Human Rights and constitute the ultimate cruel, inhumane and
degrading punishment. Furthermore, Chi's attorney claims that he was denied
the right to contact the Honduran consulate which is a right given to
foreigners under the1963 Vienna Convention on consular relations.
Due to the recent decision by the Supreme Court to hear two Kentucky cases
on the concern that the lethal injection protocal is cruel and inhumane and
the fact that one of last weeks schedueld Texas executions was granted a
stay as a result of that decision, there is some thought that Heliberto will
receive a stay as well.
Late Friday Governor Rick Perry's office said the governor has no authority
to issue a death penalty moratorium nor does he see a need for one, even
though the US Supreme Court may halt additional executions as it considers
whether lethal injection is cruel and unconstitutional.
The Governor's office says it has received a request for clemency from
attorneys representing the inmate scheduled for execution Wednesday. The
Texas Board of Pardons and Paroles will review the request.
